ex wife claiming son has anybody ran into this my ex wife is claiming my son on her taxes even though he lives with me more then 6 months of the year one of the years 11 months this is for 2008 and 2009 and the irs is making me pay back the taxes we did in 1999 have a medeiation agreement that said she could claim him but a year after that agreement he has live with me all year so i never modified it so would that over ride him living with me all year she can still claim him not sure what to do he is 15 dont want to have to spend thousands for a lawyer please help

By the way punctuation is your friend. You should try using it sometime.

If the kid lived with you according to the IRS you should get the exemption. What your divorce decree with the state court says is another matter entirely.

OK, now for an answer.

eFile as early as you can. If your ex- managed to file before you, your return will be rejected because your son's SSAN has already been used. If your return is processed first, your ex's return will be rejected for eFile.

Then, file the same return by mail, ie., a paper return. When the IRS worker enters your information, he/she will notice that your son's SSAN has been used and whose ever return will be on-hold.

The IRS will send both you and your ex- letters, telling you that two people had claimed your son as a dependent, and will ask each of you to show:

Where the kid lives.

How long the kid stayed with you.

You might need school records, medical records, etc.

And, this won't be resolved until summertime.

your ex-wife gets the kid because it is set in court that she can claim him, so she wins even if you try to fight her on that, irs will always give her the money, what you can do is a get a lawyer and try to fix that, to change the divorce decree and then when you try to claim him irs will ask what rights do you have to claim him and you send them the court order, of where you changed the divorce decree agreement

If the child lives with you, you are going to get the exemption unless you give it up in writing. You will have to file a paper return and IRS will sort it out.
